SCOPE AND CONSENT

At Legalhood, your trust is our top priority. That’s why we respect your privacy and protect it with powerful encryption tools and rigorous data management practices.

Security and confidentiality are at the heart of the design of all our platforms and services. And we are constantly striving to strengthen them.

The purpose of this Policy is to tell you how we treat your personal information, what information we collect and what we use it for. All capitalized terms used but not defined in this Policy have the meanings ascribed to them in the Terms and Conditions.

This Policy describes your rights with respect to the privacy of your personal information, including its collection, use, disclosure, retention and protection. It applies to all Legalhood applications, services and tools (the “Services”) that incorporate this Policy by reference, regardless of how you access such Services, including access through mobile devices.

By using our Services or creating an Legalhood Account, you agree to the terms of this Policy as well as our Terms and Conditions, and you consent to the collection, use, disclosure and retention of your personal information in accordance with this Policy and our Terms and Conditions. If you do not provide us with the information we request, we may not be able to offer you all of our Services.

Legalhood is responsible for processing data and your personal information in accordance with this Policy and the Terms and Conditions.

PERSONAL INFORMATION

“Personal information” is information that is associated with a specific individual and can be used to identify that individual, either with that information or with that information in combination with other information held by Legalhood Inc. or to which Legalhood may have access. Personal information does not include information that has been rendered anonymous or aggregated in such a way that it can no longer be used, either in combination with other information or otherwise, to identify a specific individual. For example, business contact information (such as business address or telephone number) is not considered personal information in some countries.

STORAGE AREA

Legalhood stores and processes your personal information on servers located in Canada that are protected by physical and technological safeguards.

CHANGES TO THIS PRIVACY POLICY

Legalhood may amend this Privacy Policy at any time by posting the amended provisions on www.Legalhood.com (the “Site”). The modified provisions will automatically come into force 30 days after their publication on the Site.

PRIVACY STANDARDS

Legalhood’s privacy standards represent our commitment to protecting your personal information and complying with our privacy obligations, regardless of where your personal information is collected, processed or stored.

COLLECT

Legalhood collects personal information from you and the devices you use to access or use our Services (including mobile devices). Some of the categories of personal information we collect include, but are not limited to, the following.

PERSONAL INFORMATION YOU GIVE US WHEN YOU USE OUR SERVICES

  • Identifying information, including your name, attorney number (if applicable), address, telephone number and e-mail address;
  • Financial information such as credit card or bank account numbers, for payment of our services;
  • You may also send us other information in the context of correspondence on the Site or correspondence to Legalhood;
  • Other information that we are required to request under applicable law in order to authenticate or identify you, or to use or verify information that we have collected.
  • Legalhood.com uses remarketing web analytics tools. These tools work by inserting tracking code into web pages to collect certain data about visitors, including the computer’s IP address and the device or network used to access the site. Web analytics uses cookies, which are text files of negligible size that are transmitted to your browser when you access a website. You may refuse the use of cookies by selecting the appropriate settings on your browser (please note that doing so may prevent you from using the full functionality of this website). Some service providers may also allow you to refuse the use of cookies for advertising purposes (such as Google’s ad settings);
  • For users who do not submit a service request, their information will be destroyed one year after their last visit to the Site.

PERSONAL INFORMATION WE COLLECT AUTOMATICALLY WHEN YOU USE OUR SERVICES

We also collect information relating to your use of our Services, advertising or e-mail communications. This information is typically collected from your computer or other devices, including mobile devices.

  • Device identifier or unique identifier, device type, advertising identifier, unique device code;
  • Location data, including the location data of your mobile device. Keep in mind that :
    • Most mobile devices allow you to control or disable the use of location services on your mobile device in the device’s settings’ menu;
    • You may receive a supplementary notice describing any other type of information that we may require and that is not included here.
  • Data on computer and connexion;
  • Page view statistics, traffic to and from sites, referring URLs, advertising data, IP address, browsing history and Web log information.

PERSONAL INFORMATION WE COLLECT USING COOKIES, WEB BEACONS, AND SIMILAR TECHNOLOGIES

We use cookies, Web beacons, unique identifiers and similar tools to provide and improve our Services and personalized advertising and promotions, and to provide you with a safe and personalized experience on our Site. We collect information about the pages you visit, the links you click and other activities you engage in regarding our Services, advertising or e-mail communications.

A cookie is a small data file stored on your computer by your browser. Cookies enable you to carry out operations on our Site and help us to improve and personalize your online browsing and overall experience. We use cookies to store activity relating to your Conflict negotiation(s), to recognize you when you return to our Site and to analyze visitor behavior.

You can set your computer to notify you each time a cookie is sent or to disable cookies. You can do this by modifying your browser settings. As every browser is different, please consult the help menu to find out how to modify your cookie settings. If you disable cookies, you will not have access to many of the features that enhance your visitor experience, and some of our Services will not function properly.

PERSONAL INFORMATION FROM OTHER SOURCES

We may supplement the information we collect with information from third-party sources and add it to your Account information. For example, to the extent permitted by law, we may collect public demographic information, additional contact information, credit check information and information from credit bureaus. We may combine your information with data we obtain from other sources.

We may also allow you to share information with third-party social media sites or to use social media or other sites to create or log into an Account. These social media sites may give us access to certain personal information they hold (e.g., posted content and information about advertisements you have seen or clicked on, etc.) from your interaction with the Online Services. Please remember that you control the personal information to which we have access through the privacy settings of these third-party sites and the permissions you give us when granting access. By associating an account managed by a third party with your Legalhood Account and by authorizing Legalhood to access this information, you agree that we may collect, use and store information from these sites in accordance with this Policy.

If you share another person’s personal information with us, you must have their consent. You agree to notify them that we have collected their personal information and explain how we collect, use and disclose that information.

If you are a lawyer User, and you provide us with your client’s personal information, you must have their consent. You agree to notify them that we have collected their personal information and explain how we collect, use and disclose that information.

USE AND RETENTION 

We use your personal information to manage, improve and personalize our Services, to communicate with you, to provide you with customer service, to personalize our advertising and promotions, and to detect, prevent and counter fraudulent or illegal activities. You agree that we may use your personal information to:

  • Provide you with access to our Services;
  • Offer you website content;
  • Give you access to your Dispute negotiation history, your offers and other features;
  • Provide you with opportunities on behalf of our strategic partners. Please note that we will never share your financial information with them without your explicit consent;
  • Customize, measure, and improve our Site and Services;
  • Provide other services that you requested as described when we collect the information.

Communicating with you and provide you with customer service

  • Provide you with customer service relating to our Services;
  • With your permission, communicate with you by e-mail, telephone (via automated or pre-recorded calls) or text messaging (if applicable) to resolve disputes, collect fees, troubleshoot problems with your Account or our Services, or for any other purpose permitted by law and in accordance with this Policy;
  • Compare the personal information you provide to us to confirm its accuracy and to verify it with third parties, if necessary.

Personalize our advertising and marketing communications according to your needs

  • Personalize, evaluate and improve our content and advertising according to your advertising preferences;
  • Communicate with you by e-mail, telephone, text messaging (if applicable and with your consent), postal mail or other means of communication authorized by you, in order to offer you promotions and information about our Services and the services of our affiliates. You authorize Legalhood to use the contact information that you have provided to contact you by email and SMS text if you have consented to such contact. Message and data rates may apply;
  • Send you targeted advertising and promotional offers and inform you of changes to our Services based on your communication preferences.

Detect, prevent and diminish fraudulent or illegal activities

  • Prevent, detect and investigate cases of fraud, intrusion or potentially prohibited or illegal activities;
  • Ensure compliance with our Terms and Conditions or other policies.

Legalhood retains your personal information for as long as it is necessary and relevant for our operations. If you have provided us with personal information without purchasing our Services, we will destroy it after one year of registration. In addition, we retain certain personal information associated with closed Accounts in order to comply with legal requirements, prevent fraud, collect amounts owing, resolve disputes, ensure the resolution of technical problems, facilitate investigations, ensure the application of our Terms and Conditions and take other measures authorized by law.

When we no longer need your personal information, we will destroy it in a secure manner.

MARKETING AGENCIES

We do not sell or rent your personal information to third parties for marketing purposes without your explicit consent. If you do not wish to receive commercial communications from us, you can unsubscribe by clicking on the unsubscribe link in the e-mail you have received, by changing your communication preferences in your Account or by indicating your preferences within one of our direct communications.

ADVERTISING

We do not authorize third parties to track or collect your personal information on our Site for their own commercial purposes without your express authorization.

ACCESS

We take steps to ensure that the personal information you provide is accurate and up-to-date, and that you have the ability to access or change it.

  • You can view, verify and modify most of your personal information by logging into your Account. Please update your personal information promptly if it changes or is inaccurate;
  • Upon your request, we will close your Account as soon as reasonably possible, based on your Account activity and in accordance with applicable laws;
  • We will respect your legal rights to access, amend or delete your personal information.

DISCLOSURE

In some cases, Legalhood may disclose your personal information to Legalhood affiliates (BidSettle Inc.) or other third parties. We may need to do so in order to operate our business, to provide you with access to our Services, to comply with our legal obligations, to enforce our Terms and Conditions, to facilitate our advertising, or to reduce or prevent fraud in connection with the use of our Services. We limit the disclosure of personal information to that which is directly relevant and necessary to achieve the specific purpose. As mentioned above, we do not disclose your personal information to third parties for commercial purposes without your express authorization.

In particular, we may use your personal information for the following purposes:

  • In the event of a merger with or acquisition by another company, Legalhood may disclose information to that company. If so, we will require the new combined entity to comply with this Policy with respect to your personal information. If we intend to use your personal information for any other purpose not identified in this notice, we will notify you in advance.

Service providers and financial institution partners

Your information may be managed and processed by third-party service providers who assist us in the management of our Services, as well as in fraud investigation, expense recovery and other activities. Some suppliers may be located outside Quebec, in Canada and the United States (servers) and in Pakistan (management by subcontractors of our technological platform).

Law enforcement, legal proceedings, and as authorized by law

  • To comply with Legalhood’s legal requirements, enforce our policies, or protect anyone’s rights, property, or safety;
  • To law enforcement, government agencies, or authorized third parties, in response to a verified request regarding a criminal investigation or suspected illegal activity or other activity that may result in legal liability for us, you, or another Legalhood User. We will only disclose information that we deem relevant to the investigation or request, such as name, city, province, postal code, telephone number, e-mail address, User history, IP address, fraud complaints, and any other information we deem relevant;
  • To credit bureaus authorized by applicable law (e.g., late payments, overdue payments and other defaults on your Account that may appear in your credit report);
  • To third parties entitled to do so by virtue of a legal or regulatory requirement.

Other parties requiring your information and as authorized by you

  • Site Users, with your authorization or by virtue of your use of our Services (e.g., if you initiate a Dispute negotiation or make a Demand Letter, the other party may request some of your contact information in order to resolve the dispute).

SECURITY

Legalhood protects your information using state-of-the-art technical security measures to reduce the risk of loss, misuse, unauthorized access, disclosure and modification. Some of our security measures include the use of firewalls and data encryption, control of physical access to our data centers and control of information access authorizations. Legalhood stores and processes your personal information on servers located in Canada that are protected by physical and technological security measures.

Furthermore, Legalhood uses the TLS v1.2 protocol, which is secured with encryption methods offering the highest level of security available today. However, while we make every effort to ensure the protection of your personal information once it reaches us, there is no way to guarantee 100% data security during transmission over the Internet or any other public network.

As for Legalhood’s e-signatures, we use eversign.

WHAT HAPPENS WHEN YOU SHARE YOUR PERSONAL INFORMATION ON LEGALHOOD’S SITE?

For any dispute negotiation or formal notice, the other party only has access to the information you provide via the Site. For example, in the case of a negotiation on Legalhood, the other party to the Dispute can see the descriptive elements of the Dispute such as facts and amounts of money.

To facilitate the protection of your private information, we allow only limited access to other Users’ contact and financial information, as needed, for the purpose of processing Agreements and obtaining payments. However, when Users participate in a Dispute negotiation, they have access to the name, e-mail address and contact information of the parties to the negotiation.

UNWANTED OR THREATENING EMAIL

Sending unwanted or threatening email is against our Terms and Conditions. To report Legalhood-related spam or spoof emails, please forward the email to info@legalhood.com.

CHILDREN’S PRIVACY

Legalhood is intended for an audience of 18 years and older and is not intended for people under the age of 18. We do not knowingly collect personal information from users under the age of 18.

THIRD PARTY PRIVACY PRACTICES

This Policy covers only the use and disclosure of the personal information we collect from you. If you disclose your information to another party or any third party, their privacy policies and practices will apply. We cannot guarantee the confidentiality or security of any information you disclose to another party or any third party.
